SBV currently seeks an Employee Relations Case Manager responsible to manage and coordinate all bargaining council and labour department cases providing SME industrial relations expertise, strategic advice, and operational support

Job Summary:
Lead, manage and coordinate all Labour relations cases on behalf of SBV for the following but not limited to bargaining council, labour department & CCMA
•Lead and be responsible for all complex cases from end to end
•Manage and coordinate all CCMA, bargaining council and labour department cases, assigning less complex cases to the IR Specialist/s
•Represent SBV as the primary representative at the Bargaining Council, CCMA, and labour department and applying the principles of procedural and substantive fairness to each case
•Create the framework and applicable governance documents for, but not limited to:
o Case compilation
o administrative processes
o reviews and delegation of authority
o Reporting.
•Manage and assist stakeholders to identify the important elements of cases and identify and plan for the most effective course of action
•Manage and coordinate all CCMA, bargaining council and labour department case interventions
•Provide SME advice and guidance for both Business as usual activities and projects.
•Identify and rectify issues raised at the CCMA, bargaining council and labour department and responsible to implement remedial actions
•Investigate and create awareness of delays in cases, driving all actions necessary to resolve challenges / obstacles hindering the completion of cases
•Conduct ER trends analysis and establish a regular reporting cadence on investigations.
•Partner with Line management and the Risk department to ensure standards and timelines for cases are driven and met
•Liaise with external legal advisors if required

Manage case preparation and administrative process:
•Lead the compilation of case documentation for all proceedings with external bodies, i.e., CCMA, Labour department, Bargaining Units etc.
•Lead and assist by conducting thorough investigations and gathering evidence in preparation for the case
•Lead and coordinate the preparations towards the investigative reports with analysis, findings and recommended disciplinary or corrective actions
•Review documents, compile and analyse data, conduct investigation interviews, draft investigation reports; communicate with HRBPs, employees, managers, and employment legal counsel regarding employee relations issues; assist with maintenance and update of investigations database and documentation.
•Create resources and documentation for multiple stakeholders, to create clarity in our processes and raise awareness of Employee Relations

Governance and compliance:
•Embed and maintain correct procedures with specific reference to legislation, policies, the SBV code of conduct and Standard Operating Procedures
•Participate in the compilation of new policies and procedures and to drive the review of existing documentation in accordance with agreed action plans to ensure a centralized, standardised and up to date documentation system is maintained
•Operationalise and enforce policies and procedures through managing and mitigating non-compliance issues and other items identified
•Monitor case outcome and performance by gathering relevant data and producing statistical reports with recommendations for improvements
•Monitor developments within the labour relations field and advise on best labour relations practices

Training and coaching:
•Provide input into the creation of the IR training program and facilitate the training sessions with line and HR
•Responsible to provide a high end consultancy service to certify the best possible outcome for SBV by:
oConsulting with and preparing all applicable witnesses & or stakeholders
oDrafting all required correspondence, in conjunction with Legal where applicable
oDebriefing stakeholders on areas of development
•Analyse non-conformances and together with the respective IR Specialist and Learning & Development, identify training needs

Stakeholder management:
•Provide high level support nationally on critical matters to enable the delivery of high performance
•Own the below applicable stakeholder relationships to ensure seamless and effective engagements, execution and opportunity discovery:
o Union/s
o Customers
o Regulatory
o Internal departments
o Lawyers
•Establish and maintain relationships with bargaining council and labour department stakeholders
•Liaise and work closely witnesses, management and unions to establish requirements and procedures to follow
•Maintain a sustainable partnership with the union in order to pro-actively assist in managing the labour climate within SBV

Provide leadership to employees within the organisation, creating a winning culture and high morale
Lead as an Ambassador and executor of Change
•Act as a change management architect in periods of change to ensure continuity to operations
•Effectively communicate and embed new processes and procedures relevant to the Employee Relations Department as they occur addressing or escalating matters / concerns Facilitate the necessary presentations, workshops or forums in order to ensure consistent and accurate communication is given across one’s centre/s

•Provide leadership to employees within the organisation, creating a winning culture and high morale
•Initiate and lead a culture of performance driven output through shared purpose vision and values

Requirements:
•5 years’ experience as an IR company representative at CCMA and or Bargaining Unit Councils in a unionized environment preferably within manufacturing and/or practicing labour law
•3 years should be in presenting complex bargaining council and labour department cases
•Experience within Union Engagement and Council/CCMA Representation
•A broad understanding of applicable South African legislation is essential

• 3-year Diploma / 3 year Degree in Industrial Relations, HR Management or Labour Law
• 1 year Certification in Advanced Labour Law (Advantageous)
