Job Title: Tax Consultant

Job Summary:
The Tax Consultant will be responsible for providing exceptional client service to tax clients as well as BDO (internal) in respect of tax opinions and consulting. Offer a legal, council and risk adverse service to clients by way of liaising, advising on best practice and ensurance of legal governance. Provide innovative commercial insights for clients, adapt methods and practices to resolve and address complex business matters.

Job Description:
•Transaction support (preparing legal agreements)
•Providing legal opinions on procedure in terms of the Companies Act/Companies Regulations/Close Corporations Act
•Providing legal opinion on application of the Companies Act/Companies Regulations/Close Corporations Act/National Credit Act/Income Tax Act Etc.
•Application of MOI/SHA (to e.g. determine shareholder voting rights Etc.)
•Reviewing legal agreements (and E.g. NGO applications etc.)
•Providing comment on proposed amendments and preparing lease agreements/loan agreements/AODs etc.
•Responding on Trust queries (in-office/clients),
•- Trust registrations,
•- Amendments to Trusteeship,
•- Amendments to Trust Deed,
•- Preparing Trustee resolutions to authorise transactions,
•- Copies of Trust documents (to clients/banks/attorneys etc.)
•- Administration of deceased estates (including inter alia: reporting the Estate to the Master,
•- Publication in the Herald and GG,
•- Opening bank account with Investec,
•- Preparing Liquidation and Distribution account (which may/may not include liaising with valuers and conveyancer’s),
•- Liaising with the Master on Masters’ requirements, tax clearance etc.)
•- Preparing Wills,
•- Preparing Power of Attorney,
•- Preparing Letter of wishes (in respect of direction to Trusts)
•- Preparing opinions on the interpretation of Wills Act/Trust Property Control Act/Administration of Estates Act (for clients/in-house).

Requirements:
Qualifications:
•Bachelor’s degree / LLB or a similar major & postgraduate qualification in Tax
•Advanced degree such as LLB – studying towards a qualification in Tax
•Admitted Attorney – 2 years auditing/accounting or law experience
•Prior experience within Audit or Law Industry Legal Articles
•In depth knowledge of trust laws and regulations, Income Tax Act and Companies Act.
